The Ministry of Internal Affairs of the RF resumes the practice of HQS work permits revocation

Since October 13, 2022 the Ministry of Internal Affairs of the Russian Federation will resume the practice of revoking the work permits of the highly qualified specialists (hereinafter the "HQS") who have been abroad for more than 6 (six) months.

According to the Federal Law as of July 25, 2002 № 115-FL "On the legal status of the foreign citizens in the RF" one of the grounds for the revocation of the HQS work permit is stay of the foreign citizen outside the RF more than 6 (six) months. Due to the Decree of the Russian President as of June 15, 2021 № 364 the implementation of that rule was suspended since June 16, 2021 until the expiry of 90 (ninety) days from the cancellation date of the temporary restrictions on transport links with the foreign countries which were imposed in Russia.

As the temporary restrictions on entry into the RF have been cancelled since July 15, 2022 (based on the Decree of the Government of the RF as of July 14, 2022 № 1267), the HQS, who perform employment duties based on the valid work permits in the RF and who are physically abroad, must enter the RF by October 13, 2022, i.e. the in 90-day term counted since July 15, 2022 (the date when all transport restriction due to the pandemic were cancelled).
