Fines for preventing an employee from exercising the right to replace a credit institution

Since 06.08.2019, a separate composition has appeared in the Code of Administrative Offences of the Russian Federation (hereinafter referred to as the "Administrative Code of the Russian Federation"), according to which employers will be punished for preventing an employee from exercising the right to replace a credit institution to which wages should be transferred.

The changes affected paragraph 1 of Part 6 of Article 5.27 of the Administrative Code of the Russian Federation.

Until 06.08.2019, fines for the specified offense were also applied, but the general norm for violation of labor legislation was in effect.

Under the new rules, fines have become higher. They are equal to fines for non—payment of wages and amount to: for officials — from 10,000 to 20,000 rubles; for individual entrepreneurs - 1,000 to 5,000 rubles, for legal entities — from 30,000 to 50,000 rubles.

A warning will continue to be applied as an alternative to penalties.

In addition, the period for which the employee must notify about the change of the credit institution is increasing: previously, the period was 5 days, from 06.08.2019 it is 15 days. The new term is prescribed in Article 136 of the Labor Code of the Russian Federation.
