Changes in the Rules of Migration Registration of Foreign Citizens and Stateless Persons in the Russian Federation

On March 20, 2019, the amendments made to the Rules of Migration Registration of Foreign Citizens and Stateless Persons in the Russian Federation came into force. The Rules were approved by the Decree of the Government of the Russian Federation No. 246 dated March 7, 2019 (hereinafter referred to as the "Resolution").

Thus, new requirements are being introduced for filling out a notification of the arrival of a foreign citizen at the place of stay:
If the receiving party is a legal entity, in the corresponding column of the notification it is necessary to indicate not the "actual address" of the organization, but the address of the organization specified in the Unified State Register of Legal Entities, since the location of the legal entity is determined by the place of its state registration in the territory of the Russian Federation (Part 2 of Article 54 of the Civil Code of the Russian Federation).
The name and details of the document confirming the right to use the residential or other premises provided for the actual residence of a foreign citizen have been added to the number of information required from the inviting party. If the receiving party is a legal entity, it is also necessary to indicate information about the title documents for the right to use the premises.
When filling out the notification form, the use of abbreviations and abbreviated words is provided, only corrections are not allowed. As a rule, this is relevant when specifying the name of the organization, the address of the place of residence of a foreign citizen and the location of the receiving party.
A list of documents has been established that the receiving party is obliged to submit to the migration registration authorities in respect of foreign citizens of the member states of the Eurasian Economic Union:
identity document;
migration card (except in cases of exemption of a foreign citizen from the obligation to fill out a migration card in accordance with an international agreement of the Russian Federation);
employment or civil law contract;
documents confirming family relations (for family members of foreign citizens of the member states of the Eurasian Economic Union).
We also draw your attention to the fact that you can submit notifications about the departure of a foreign citizen not only directly to the territorial body of the Ministry of Internal Affairs of the Russian Federation, but also through the MFC and postal communication. If the migration registration data of a foreign citizen changes, the relevant notifications can be submitted through the MFC.

In turn, upon departure of a foreign citizen from the organization in which he performs work in a shift mode and at the address of which he is registered at the place of stay, the administration of the relevant organization is obliged to submit such a foreign citizen to the territorial body of the Ministry of Internal Affairs of the Russian Federation no later than 7 working days from the date of departure.notification of departure of a foreign citizen.
