Mandatory medical examination and fingerprinting of foreign citizens

December 29 , 2021 Federal Law No. 274-FZ of 01.07.2021 comes into force on the need for medical examination, fingerprint registration and photographing for all foreign citizens entering the Russian Federation:
Foreign citizens who have arrived in the Russian Federation for the purpose of carrying out work activities must undergo these procedures within 30 days, either when applying for a patent or when obtaining a work permit. This obligation also applies to highly qualified specialists (VKS), employees of branches, representative offices and subsidiaries of foreign legal entities. Foreign citizens employed in the Russian Federation before 12/29/2021 are also required to undergo the above procedures.
Foreign citizens who have arrived in the Russian Federation for other purposes for a period of more than 90 days must undergo procedures within 90 days from the date of entry into the Russian Federation.
Medical examination is possible strictly in medical institutions approved by the Government of the relevant subject of the Russian Federation. So, in Moscow, for foreign citizens who have entered for the purpose of carrying out work, this is the GBUZ "MNPTSDK DZM". At the moment, only the branch of this institution, located in the Sakharovo MMC, operates in a "one-stop shop" mode, a phthisiologist does not receive a doctor in all other branches – accordingly, it is required to visit the branch of the GBUZ "MNPC of tuberculosis control DZM" separately to undergo a fluorography procedure and receive a specialist.

At the moment, the validity period of medical documents is 3 months. After the expiration of the specified period, the foreign citizen must again undergo a medical examination. The text of the Order of the Ministry of Internal Affairs of the Russian Federation on the approval of the procedure for the provision of medical documents by foreign citizens in connection with their repeated medical examination is posted on the Federal Portal of draft regulatory Legal Acts of the Russian Federation. According to the published draft order, foreign citizens are required to provide supporting documents to the Ministry of Internal Affairs and their authorized organizations within 30 days from the date of expiration of the previous ones. We recommend submitting documents to the body of the Ministry of Internal Affairs of the Russian Federation that issued a foreign citizen of the RNR / patent, in order to avoid possible loss of information when it is transferred between divisions of the Ministry of Internal Affairs of the Russian Federation.

Fingerprinting and photographing procedures are carried out after receiving the results of a medical examination. These procedures must be completed   once, that is, during subsequent entry into the Russian Federation or receipt of PHP / patents, these procedures are not required.

At the moment, in Moscow, these procedures are carried out in the MMC Sakharovo. It is possible that later these procedures will be additionally carried out by the territorial ATS at the place of migration registration of a foreign citizen.
The above-mentioned requirements for medical examination, fingerprinting and photographing do not apply to the following categories of foreign citizens:
citizens of the Republic of Belarus;
children under 6 years old;
employees of international organizations and other foreign citizens with diplomatic status.
In accordance with Part 23 of Article 5 of Federal Law No. 115-FZ of July 25, 2002 (as amended. dated 02.07.2021), the period of temporary stay in the Russian Federation of foreign citizens is reduced in case of non-fulfillment by these foreign citizens of their obligations to undergo mandatory state fingerprint registration, photographing and (or) medical examination. In case of failure to provide the documents issued by the results of the medical examination, the work permit, temporary residence permit and residence permit are subject to cancellation in accordance with paragraph 10, paragraph 9 of art. 18, item 13, item 1 of Article 7 and item 13, item 1 of Article 9 of Federal Law No. 115-FZ of 25.07.2002.
