Cancellation of personal cards according to form no. T-2

Since September 1, 2021, a new procedure for maintaining workbooks has been in effect (approved by the Order of the Ministry of Labor of the Russian Federation No. 320n dated 05/19/2021), which does not contain provisions obliging the employer to keep personal employee cards in form No. T-2. But the employer has the right to continue their management, including in electronic form. It is no longer necessary to introduce the employee to new entries in it.

We remind you that earlier employers had to fill out personal cards with the employee's data in paper form, with all new records the employee had to be acquainted with the signature (Rules for maintaining and storing workbooks, approved. Decree of the Government of the Russian Federation No. 225 dated 16.04.2003).

If the employer has decided not to keep personal cards anymore, then it is necessary to check local regulations (LNA) and exclude the corresponding obligation. Such LNA include, for example, the rules of internal labor regulations (PVTR), instructions on personnel records management and regulations on how to conduct personal affairs. The obligation to maintain personal cards may be excluded by an order to amend the relevant LNA.

If the LNA contains such an obligation, and the employer no longer fills out the cards, then he may be held liable in the form of a warning or an administrative fine imposed on legal entities in the amount of thirty to fifty thousand rubles (Article 5.27 of the Code of Administrative Offences of the Russian Federation).

It is also recommended to issue an order to refuse to maintain personal cards, in which it is necessary to specify the date from which their filling stops. Personal cards for each employee must be kept for 50 years (Rosarchiv Order No. 236 dated December 20, 2019).

In addition, it is necessary to check the nomenclature of cases in the organization for the presence of mention of personal cards. If you refuse to maintain them, you must approve a new nomenclature.
